AN: This is my first Demily fic so i would love to know what you think. Emily and David are real people and don't belong to me and i'm not going to pretend the do.

A Question of Fidelity

David pulled her off to the side, she knew he would, it was always him who noticed when something was up and she’d never been able to hide her true emotions well, especially not at six in the morning.

“Em? You going to tell me what’s going on, because I really don’t fancy guessing, Jaden was sick last night so I haven’t had much sleep” Emily nodded, sometimes she hated being reminded that David had a wife and son to go home to and the most she had was her sister, though they were rarely home at the same time, especially recently their filming schedules clashed badly.

“He broke up with me” she said by way of explanation for her behaviour that morning. They’d only been filming for ten minutes and they hadn’t even managed to get the first line right, it wasn’t even particularly hard, but it was obvious Emily’s heart wasn’t in it.

“Gerard?” David asked disbelievingly, he’d only had the pair over for dinner three days ago and they’d seemed fine.

“Yeah” Emily nodded tears starting to stream down her face, she hadn’t cried the night before just crawled into bed alone and fallen into an exhausted and fitful sleep. David wanted to ask why, why anyone would break up with her, she was gorgeous and talented, not to mention smart and funny, hell if he wasn’t married... no, he couldn’t think about that.

“He’s crazy Em, he never should have let you go. Stupid prudish Englishman” Emily smiled weakly and his arms wrapped around her, she leant into him easily.

“Thanks” it didn’t change much though, she remembered wryly, some of her usual spark having disappeared from her eyes. He could tell her she was as wonderful as he liked and Gerard as stupid as he liked but she’d still be going home to an empty bed and an empty house at the end of a fifteen hour day. She liked the days they had to work overtime, sometimes she’d deliberately mess around to prolong leaving for the day, because spending time with David was the highlight of her life, not that she didn’t like spending time with Michaela and the others as well. But she and David seemed to connect on a level the others didn’t understand, as if they transcended usual relationship markers, they’d always been more than just friends and colleagues.

He held her for as long as she wanted, until her tears stopped falling, he wiped them away gently, and she knew the crew was waiting for them but it wasn’t enough to drive her from his arms and back to their alter egos as Booth and Brennan who were currently freezing their asses off while investigating the death of a hockey player.

“You gonna be okay?” David asked pulling back from her slightly.

She sighed “Yeah” David wasn’t convinced.

“Is Zooey going to be home tonight?” Emily thought for a moment and shook her head, her sister was filming nights for the rest of the week.

“Okay, well I guess I’m coming home with you” he declared slapping his hands together.

“What?” Emily was sure she’d missed something, she’d just been through a breakup what did that have to do with David coming home with her?

“Hey, you might be an actress but that smile isn’t fooling me, I know you. If you go home by yourself you’re just going to find the most depressing movie you can and cry yourself to sleep on the sofa after eating a pile of those organic chocolate truffles you seem so attached to” Emily hated to admit he was probably right.

“You can’t come home with me David, what about Jaime and you said Jaden was sick. I’ll be fine, they need you more. Besides Jaime already complains about how much time you spend with me. What if I go see my parents?” she compromised, she hated David putting her before his wife and child because she didn’t deserve it and she didn’t want to come between them.

“You’re parents aren’t even in the country” David reminded her smirking.

“I’ll be fine” she insisted, he didn’t have time to argue though because it seemed that Ian, who was directing the episode was starting to get anxious, glancing over to them every few seconds as if contemplating whether it was safe to approach. David nodded at him and dragged Emily back onto the set.

“I’m still coming home with you” he whispered before they were situated again, and she couldn’t help but shiver, wishing that David was accompanying her home for another reason.

“Fine” she accepted, “Don’t forget to call Jaime though” sometimes she wondered if she was more invested in his marriage than he was.

She caught him watching her during the day, it seemed that every time she walked into a room she could feel his eyes on her, silently asking if she was okay, she’d always send a brief smile his way, but she knew it wouldn’t convince him. It didn’t bother her as much as she thought it should, having his eyes on her, in fact it was kind of nice to know that someone still cared about her, that she still mattered that much to someone.
“You ready to go?” he asked the moment they’d finished filming for the day. She laughed at his eagerness.

“Just as soon as I’m out of these clothes she said gesturing to her ice skates, maroon beanie and fitted jacket. David had to agree, it wasn’t really her style and he definitely needed to get out of the suit before they left. He walked her to her trailer before disappearing into his own. When he met her again she was still in jeans, but they weren’t the same ones she’d been wearing a few minutes earlier, her hair was down, the way he liked it and she was wearing the green sweater that she knew he loved. She was still wearing a beanie but this one was striped in rainbow colours, her nose was already red from the cold, he couldn’t deny she looked cute. He smiled brightly and wrapped an arm around her shoulder casually as they signed out.

He tried to keep things light reminding her that she’d get to spend the next day watching him get bashed by a hockey stick while she sat on the sidelines, that seemed to cheer her up a little, not that she’d be able to watch all of his hockey game, most of her scenes would be done separately.
When they got to her place he collapsed easily onto the couch and so did she, she felt no need to offer him a drink not because she was impolite but because she knew he would get one when and if he wanted one, he always did. Her eyes slipped shut as her head fell back against the plush cushion. She was tired, actually exhausted would be a better word, maybe beyond exhausted if that was possible. Their fifteen hour day had quickly turned into almost seventeen hours, a result, she was sure, of her breakdown that morning and subsequent lack of concentration. Even if she went to sleep right then she wouldn’t get her recommended eight hours, she sighed, even when she did get to sleep she doubted it would be restful. She’d counted on her relationship with Gerard, assuming that it was the kind that would last a lifetime, or at least she thought she had. Maybe not, she realised; if she’d believed it would last why hadn’t she ever taken him to any dinners or press releases, if she was sure it would last why not let the media in on it, especially after two years. So maybe she hadn’t been quite as sure as she thought, maybe Gerard noticed what she didn’t, that it wasn’t him she really wanted to be with.
Her thoughts were distracted by David pulling her shoes gently off her feet and exposing them to the cool air of her living room. When he pulled her socks off she shivered, wondering what he was doing. He sat back to where he had been previously but this time he was facing her.

“Feet up” he gestured to his lap and she turned too daintily lifting her legs until her bare feet were rested on his thighs. He took her left foot in his hands encompassing it completely and rubbing between them until it was warm before moving on to her right foot. He began to rub the sole of her right foot with his thumbs gently and she couldn’t help but enjoy the soothing feeling. It had been a long day and her feet were sore they’d spend hours in and out of the ice skates that day and her feet had been protesting loudly since mid afternoon. It occurred to her that she couldn’t remember the last time she’d had a foot massage, or any massage really, unless it was someone she was paying or occasionally as a precursor to sex but she found that those kinds of massages weren’t the same. Gerard had never given her a massage she realised and wondered if maybe he hadn’t been all that interested in a long term relationship either, at least not with her, regardless of what he’d said.

“So what happened?” David asked eventually still gently massaging her foot. She knew he’d ask, she’d been expecting it since they left the set, been preparing for it. Yet suddenly she wasn’t sure what to say.

“He told me that he’s ready to settle down, he wants to start a family and he said that he wished I was ready too because he really cares about me and thinks I’m great” David nodded squeezing her foot slightly between his hands urging her to continue “I told him that I’m committed to the show right now so I don’t think it’s the right time to start a family, he said that he didn’t think it ever would be, that if I was planning to start a family with him I wouldn’t have bought this place because it’s essentially a bachelor pad or maybe a house for people without kids.” And she had to admit it really was.

“But you know David, he was wrong because I am ready to settle down. I see you with Jaden and it’s all I can think about, having a baby. But I wasn’t lying, I am committed to the show right now, but that’s okay, I’m only thirty two and we’re already in our fourth season and I honestly think there’s probably only a couple of more good seasons left in the show and by then I’ll still only be thirty four and I can have a baby then.” David had never thought about it, but Emily was right, as much as he didn’t want to admit it, the show would finish in a couple of years and he wouldn’t be able to spend every day with her. They’d start seeing each other on weekends, then maybe once a month, then just at the awards shows and suddenly she’d just be a distant part of his past and he didn’t want that not for her.

“He was right too though” Emily admitted “I didn’t want to settle down with him. I didn’t realise it until he said something though, I guess I just got comfortable” she hadn’t realised she was crying until his hands moved from her foot to grasp her hands gently massaging her knuckles. She wasn’t even sure why she was crying because she’d realised that she wasn’t really upset by things ending with Gerard because she knew they would still be able to be friends. They’d been together for a long time and she still cared about him but relationships change and she knew that there was no sense mourning a relationship that changed, only one that ended.

“You know what?” she asked suddenly realising something “It’s probably a good thing I’ve got Bones right now, because starting a family would be a little difficult at the moment, I have no man” although there were tears still streaming freely down her cheeks she was smiling when she spoke and David looked up wondering what had changed. He gingerly reached up and wiped a few of the tears from her cheek.

“Guess we’d better find you one then” he said grinning back.

“Guess so” she agreed.

“Not that it will be hard” he added “I mean who wouldn’t want to date the fabulous Emily Deschanel”

“You do have a point” she agreed.

“Maybe work on the modesty thing a little” David joked “You could just marry TJ” he added a few moments later.

“Then my kids would be short” Emily argued.

“Hadn’t thought of that”

“TJ is off the list” Emily confirmed.

“Well what about Michaela, it would be very modern of you” Emily laughed, but the look on her face told David it wasn’t going to happen and they fell into a comfortable silence. Their hands were still clasped together his thumb still rubbing gentle circles over her knuckles.

“What about me, would I make the list?” the question was out of his mouth before he’d even registered what he was saying.

She considered him for a moment, wondering if he was serious and if he was what that meant. When she decided he was she replied with a quick “You’re married”

“And if I wasn’t?”

“David” she begged, her eyes pleading him not to make her answer, because she couldn’t lie to him, not about this, not about anything.

“It’s okay, I get it” he accepted sadly, mourning something that had never been. They didn’t need to say the words, but they both understood, as long as he was married, they were just friends. She would never ask him to leave his wife and he wouldn’t ask her to give up a possibility at a life, but even as he was heading home he was thinking of how to break it to his wife. He’d fallen in love with Emily.
